Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Future Talents platform, website, and related services operated by Future Talents GmbH. Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not access or use our platform.

1. Acceptance of Terms

Agreement

By accessing or using the Future Talents platform and services, you confirm that you are at least 18 years of age, have read and understood these Terms of Service, and agree to be bound by them. If you are using our services on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

Modifications

Future Talents reserves the right to update these Terms of Service at any time. We will provide at least 30 days' notice of material changes by email or via a prominent notice on our platform. Continued use of our services after changes take effect constitutes your acceptance of the revised terms.

2. Description of Services

Platform Services

Future Talents provides a talent identification, development, and placement platform connecting skilled candidates with employer partners primarily in Germany and the European Union. Our services include career assessment, skills development programs, cultural and language preparation, and job placement facilitation.

For Candidates

Candidate services include profile creation and management, access to job opportunities, participation in development programs, career coaching, and assistance with relocation to Germany or other EU countries.

For Employers

Employer services include access to our pre-vetted candidate pool, tailored talent search and matching, consultation services, and ongoing placement support. Specific terms, fees, and service-level agreements are governed by separate employer contracts.

Service Availability

We strive to maintain high platform availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice.

3. User Accounts

Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Account Security

You must notify us immediately of any unauthorised access to your account or any security breach. Future Talents will not be liable for any loss or damage arising from your failure to protect your account credentials.

Account Termination

We reserve the right to suspend or terminate your account if you breach these terms, provide false information, engage in fraudulent activity, or act in a manner that is harmful to other users, employers, or Future Talents.

4. Candidate Obligations

Accuracy of Information

Candidates are required to provide truthful and accurate information in their profiles, applications, and all communications on the platform. Misrepresentation of qualifications, experience, or credentials is grounds for immediate account termination and may constitute fraud.

Commitment to Programs

Candidates enrolled in Future Talents development programs are expected to participate actively and complete program requirements. Withdrawal from programs without reasonable cause may result in costs being passed to the candidate as outlined in the relevant program agreement.

Professional Conduct

Candidates must maintain professional standards in all interactions with employer partners, Future Talents staff, and other platform users. Harassment, discrimination, or inappropriate behaviour will result in immediate removal from the platform.

Work Authorisation

Candidates are responsible for ensuring they have the legal right to work in their target country. Future Talents provides guidance and support but cannot guarantee visa or work permit approvals, which are subject to government decisions.

5. Employer Obligations

Legitimate Vacancies

Employers must only post genuine job opportunities and must not use the platform to collect candidate data for purposes other than legitimate hiring. Employers agree to provide accurate job descriptions and working conditions.

Equal Opportunity

Employers must comply with all applicable anti-discrimination laws and ensure hiring processes are free from unlawful discrimination based on race, nationality, gender, religion, disability, age, or sexual orientation.

Fees and Payment

Placement fees and service charges are governed by the separate employer service agreement. Employers who withdraw from a confirmed placement without reasonable cause may be liable for a cancellation fee as specified in their agreement.

Candidate Treatment

Employers must treat all candidates presented by Future Talents with respect and professionalism. Any concerns regarding candidate conduct should be reported to Future Talents directly.

6. Intellectual Property

Platform Content

All content on the Future Talents platform, including but not limited to text, graphics, logos, software, and course materials, is the property of Future Talents GmbH or its licensors and is protected by German and international intellectual property laws.

User Content

By uploading content to our platform (such as CVs, work samples, or profile information), you grant Future Talents a non-exclusive, worldwide licence to use, display, and share that content for the purpose of providing our services.

Restrictions

You may not copy, reproduce, distribute, modify, or create derivative works from any Future Talents content without our prior written consent. Scraping or automated data collection from the platform is strictly prohibited.

7. Limitation of Liability

No Employment Guarantee

Future Talents acts as an intermediary and development partner. We do not guarantee employment outcomes for any candidate. Placement success depends on many factors including candidate qualifications, market conditions, and employer decisions beyond our control.

Platform Limitation

To the maximum extent permitted by law, Future Talents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services.

Maximum Liability

Our total liability to you in connection with these terms or our services shall not exceed the fees paid by you to Future Talents in the 12 months preceding the event giving rise to the claim.

8. Governing Law and Disputes

Governing Law

These Terms of Service are governed by the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

Consumer Rights

Nothing in these terms affects your statutory rights as a consumer under applicable German and EU consumer protection law.
